Welcome to Thaumazo EXpress Transport Solutions (TEXTS) Inc. (“TEXTS”, “we”, “our”, or “us”), a technology-enabled platform designed to deliver lifestyle, logistics, and transport-related services via a secure and user-friendly application (“App”). These Terms and Conditions (“T&Cs”) govern your access to and use of the App and all associated services.

By downloading, accessing, or using the App, you confirm that you have read, understood, and agree to be legally bound by these T&Cs. If you do not agree, you must refrain from using the App.

1. User Eligibility and Representations

1.1 You must be at least eighteen (18) years old and legally capable of entering into binding agreements in accordance with the Civil Code of the Philippines.

1.2 By using the App, you affirm that:

All personal information you submit, including mobile numbers and contact details, are your own and accurate;

You are not acting on behalf of another person without their lawful consent;

You are not misrepresenting your identity or impersonating any person.

1.3 Misrepresentation or unauthorized use of another’s identity is punishable under:

Republic Act No. 10175 (Cybercrime Prevention Act of 2012), particularly on identity theft and illegal use of data;

Article 178 of the Revised Penal Code (Usurpation of Name and Civil Status).

1.4 TEXTS reserves the right to verify user data, suspend or terminate accounts in violation of this section, and refer such violations to competent authorities for civil and criminal prosecution.

2. User Accounts

2.1 To access TEXTS services, you must create a user account by submitting truthful and complete information.

2.2 You are solely responsible for:

Maintaining the confidentiality of your credentials;

All activities under your account;

Immediately notifying TEXTS of any unauthorized access.

2.3 TEXTS shall not be liable for losses or damages resulting from unauthorized account use unless due to its own negligence.

3. Service Description

TEXTS is a platform that facilitates access to various logistics, dispatch, and lifestyle services through digital infrastructure.
We may act as either a service provider or intermediary depending on the nature of the transaction. All services are delivered through the App’s secure interface.

4. Pricing and Payment

4.1 All service fees are transparently displayed on the App prior to confirmation.

4.2 Accepted payment methods include credit/debit cards, e-wallets, and other channels made available by TEXTS.

4.3 Additional charges (e.g., cancellation fees, late charges) may apply under certain conditions, which will be disclosed in advance.

5. Cancellations and Refunds

5.1 Users may cancel services in accordance with cancellation policies outlined in the App.

5.2 TEXTS reserves the right to impose fees or deny refunds depending on the status or completion of services.

5.3 Refund requests will be reviewed at TEXTS’s discretion and processed in accordance with internal verification procedures.

6. User Conduct and Compliance

6.1 Users agree to:

Comply with all applicable laws, including local ordinances and national statutes;

Treat all TEXTS personnel, affiliates, and fellow users with courtesy and respect;

Use the App only for lawful, legitimate purposes.

6.2 Prohibited conduct includes, but is not limited to:

Harassment, fraud, and abusive behavior;

Unauthorized use of the App for illicit activities;

Violations of the rights of other users or third parties.

6.3 TEXTS reserves the right to suspend or permanently block any user account that engages in such violations.

7. Privacy Policy and Data Protection

7.1 TEXTS upholds the principles of privacy, transparency, and data integrity. We process personal data in accordance with Republic Act No. 10173, the Data Privacy Act of 2012, its Implementing Rules and Regulations (IRR), and related guidelines issued by the National Privacy Commission (NPC).

7.2 Personal data collected may include:

Name, email address, phone number;

Location and service interaction history;

Payment details and account credentials;

Device, app usage, and technical logs.

7.3 Such data is processed for:

Account registration and verification;

Service fulfillment and optimization;

Customer support and communication;

Compliance with legal obligations.

7.4 By using the App, you freely give informed and explicit consent for the lawful processing of your data, including processing through authorized third parties and service partners.

7.5 TEXTS enforces strict administrative, technical, and physical safeguards to prevent data breaches, and limits access to data only to authorized personnel.

7.6 You are entitled to your rights under the Data Privacy Act, including:

Right to be informed;

Right to access and rectify personal data;

Right to object to processing;

Right to erasure or blocking;

Right to data portability;

Right to lodge a complaint with the NPC.

7.7 Concerns or requests regarding your data can be directed to our Data Protection Officer (DPO) via our official contact channels.

8. Intellectual Property Rights

8.1 All content, source code, design elements, trademarks, logos, processes, and service configurations within the TEXTS platform are protected under Republic Act No. 8293, the Intellectual Property Code of the Philippines.

8.2 TEXTS is a registered trademark with the Intellectual Property Office of the Philippines (IPOPHL) under Application No. 4/2023/00505265, covering logistics software, transport services, and digital platforms across Classes 9, 35, and 39. This ensures legal protection for TEXTS's brand identity, digital infrastructure, and service framework.

8.3 You are granted a non-exclusive, revocable, and limited license to use the App for lawful personal or business use, in accordance with these Terms.

8.4 Unauthorized copying, distribution, reverse engineering, or misuse of any portion of the App or its intellectual property is strictly prohibited and will be pursued under applicable civil and criminal laws.

9. Limitation of Liability

To the maximum extent permitted by law, TEXTS shall not be liable for:

Indirect, incidental, or consequential damages;

Losses resulting from user error, third-party misconduct, or technical issues beyond TEXTS’s control.

Use of the App and services is at your own risk. TEXTS disclaims any warranties not expressly provided herein.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes shall be submitted exclusively to the proper courts of [Insert preferred city, e.g., Makati City], Philippines.

11. Amendments and Notifications

TEXTS reserves the right to modify these T&Cs at any time. Updated terms shall be posted in the App or communicated via email or in-App notices.
Continued use of the App after such updates shall be deemed as your express acceptance of the revised terms.
