Thaumazo EXpress Transport Solutions (TEXTS) Inc. is firmly committed to upholding the highest legal, regulatory, and ethical standards in the operation of its digital platform and transport logistics services. By accessing or using the TEXTS platform, you acknowledge and agree to be bound by the terms and conditions set forth herein, which constitute a legally binding agreement between you and TEXTS Inc.

We strongly encourage all users to carefully review this statement, our Terms of Use, Privacy Policy, and all related policies to ensure full understanding and compliance.

1. Terms of Use and User Responsibilities

By registering with or using the TEXTS platform, the user enters into a contractual relationship governed by the Terms of Use. These terms outline acceptable behavior and key user obligations, including:

Lawful Use – Users must use the platform in a lawful, ethical, and responsible manner, consistent with applicable laws and regulations;

User Conduct – Users shall not engage in fraudulent, misleading, abusive, or otherwise inappropriate behavior that compromises the integrity or security of the TEXTS platform;

Accountability – Users are responsible for maintaining the confidentiality of their login credentials and for any actions conducted under their account.

Any violation of these terms may result in suspension or termination of user access, without prejudice to any legal remedies available to TEXTS Inc. under Philippine law.

2. Data Privacy and Protection

TEXTS Inc. is fully compliant with the provisions of the Data Privacy Act of 2012 (Republic Act No. 10173) of the Republic of the Philippines, as well as other applicable international privacy frameworks such as the General Data Protection Regulation (GDPR) of the European Union.

Our Privacy Policy, incorporated herein by reference, provides detailed information on the nature, purpose, and scope of personal data collection and processing. Among other commitments, TEXTS Inc. undertakes to:

Collect personal information only when lawful, necessary, and proportionate;

Use and process such data solely for the legitimate purposes communicated to the user;

Implement reasonable and appropriate organizational, physical, and technical security measures to protect personal information against unauthorized access, disclosure, or loss;

Respect user rights, including the rights to access, rectify, and erase personal data, subject to limitations under applicable law.

Use of the TEXTS platform constitutes the user’s informed consent to the collection and processing of personal data in accordance with the stated policies.

3. Intellectual Property Rights

All intellectual property assets associated with the TEXTS platform—including but not limited to software, systems, processes, designs, content, and branding elements—are the exclusive property of Thaumazo Express Transport Solutions (TEXTS) Inc. and are protected under applicable intellectual property laws.

The company holds formal trademark registration filed with the Intellectual Property Office of the Philippines (IPOPHL) under Application No. 4/2023/00505265, dated 6 March 2023 and published on 14 August 2023, covering the following classes:

Class 9: Software and applications for data processing, mobile booking, and digital transport logistics;

Class 35: Business management services, logistics coordination, and digital marketplace platforms;

Class 39: Freight, cargo, and transport logistics services, including delivery and dispatch systems.

No claim is made to the exclusive use of the words “Express Transport Solutions” apart from the full mark.

Any unauthorized use, reproduction, or misrepresentation of TEXTS Inc.'s proprietary assets is strictly prohibited and shall subject the offending party to civil and/or criminal prosecution in accordance with Republic Act No. 8293, otherwise known as the Intellectual Property Code of the Philippines.

4. Platform Security

TEXTS Inc. employs a multi-layered security infrastructure to ensure the confidentiality, integrity, and availability of its systems and services. Among these safeguards are:

Advanced encryption protocols for data storage and transmission;

Secure payment gateways with fraud detection features;

Continuous monitoring systems for real-time threat assessment;

Identity verification and multi-factor authentication processes.

Users are expected to cooperate with platform security protocols and to promptly report any suspected breaches or anomalies.

5. Dispute Resolution

In the interest of fostering mutual trust and efficiency, TEXTS Inc. encourages the resolution of all disputes through good-faith negotiation. Should parties be unable to reach an amicable settlement, the dispute shall be resolved exclusively through binding arbitration, in accordance with the rules of the Philippine Dispute Resolution Center, Inc. (PDRCI).

The arbitration shall take place in the jurisdiction where TEXTS Inc. is duly registered, and the proceedings shall be conducted in English. The arbitral award shall be final and executory, and judgment upon such award may be entered in any court of competent jurisdiction.

Nothing in this clause shall preclude either party from seeking provisional or injunctive relief from the appropriate courts, when necessary to prevent irreparable harm or to enforce the terms hereof.

6. Amendments to Terms and Policies

TEXTS Inc. reserves the right, at its sole and absolute discretion, to amend, revise, update, or otherwise modify any part of this Legal Statement, the Terms of Use, Privacy Policy, or any other policy document at any time, with or without prior notice, unless such notice is required under applicable law.

Such amendments shall become effective immediately upon publication on the TEXTS platform or dissemination via official communication channels. It is the sole responsibility of the user to review the applicable terms and policies periodically.

Continued access to or use of the TEXTS platform after such amendments shall constitute conclusive and binding acceptance of the revised provisions. Should the user disagree with any amendment, the appropriate remedy shall be to discontinue use of the platform.

TEXTS Inc. shall not be liable for any loss or damage arising from a user’s failure to review or comply with any updated policies.
